What About Me?

Postby Cram66 on Sun Dec 06, 2009 4:24 am

Hello, I am new to this forum and I am hoping that I can gain some knowledge from some of you folks :) .
I, unfortunately work for a Bank and therefore DO NOT have WSIB :( , we only have private insurance....full stop.
I have worked for the bank for 20 years and had an accident 4 years ago whereby I triped on a laptop case strap and fell backwards, hitting my head off the floor and tearing my shoulder muscles, back muscles and having whiplash :( .
I received immediate medical treatment (physio etc.) and eventually after a couple of months I was fine..........Fast forward two years. I starting getting neck spasms, daily headaches and pain which started a year long investigation with my MD....test after test ect. I have been diagnosed with a narrowing in my Facet joints in my neck due to the previous injury. I continued to work during this time, albeit very difficult, sometimes I would have to work from home due to certain procedures I was having done (injections) and continued to work until I had surgery Oct. 08 to try and burn the nerves that were causing soooooo much pain. Unfortunately it was unsuccessful and long story short, I have been at home since then. My daily life has become such a struggle and since we do not have WSIB, I only have income replacement and medical. However since I was such a dedicated employee and trying my darndest to continue to work while going to appointments, I had every intention on returning to work, it now looks like that will not be the case, I need help. I looked to the bank for help with some duties around my home that I can no longer physically do and I was told that they do not provide that for me. I was told that if I need any other help or compensation etc. I am to sue my employer. Well I looked into sueing and I only had 2 years to do it! I guess being a 20 year employee and dedicated to them meant diddlely squat!!! So now I am looking for resources/support group that I can connect with, so any information you can provide me with would be greatly appreciated.
Many thanks
Bev

I wish I could help you but my knowledge in this is non-existent. For starters I would find a top-notch personal injury lawyer who can appeal on the time limit you mention of 2 years after the fact, to get a merit review; of course it may be moot at this point. Keep in mind you may have been wrongly informed, it happens all the time. I would highly recommend you contact by telephone IAVGO - http://www.iavgo.org/wedo.html Sorry to assume your in Ontario.

Hi, As stated before in your case find a good injury lawyer that will work on a contigenceny basis. The other thing you and your doctor can do is to file for Canada Pension Plan DisiabilityBenifits. Although this will not get you the help you require you will be able to hire someone to come in to assist you with the things that you can not do for yourself by yourself. Other things that you can do is to document all appointments, conversations,or any dealings you have with the insurance company or any one that has anything to do with your claim. Also keep track of your mileage to any of your appointments as your lawyer will want this. All this is to cover your -ss, and dealing with private insurance is at times a lot easier than dealing with Compensation. Good Luck and keep us informed as to what is happening with your claim as we all may be able to give you some input in as what to do .

Time for a lawyer Cram. I also am not well informed when it comes to disabled by occupation bank workers. It's too bad workers are not well enough informed about insurance carriers, including the WSIB and the consequences workers face when they suffer workplace injury. Good luck Cram.
